These terms govern your use of passmarksacademy.com, operated by Passmarks Academy. By using the site or buying a course, you agree to them. If you do not agree, please do not use the service.
The service
Passmarks Academy sells access to recorded video courses for Nepali university programmes. Courses are sold individually. Buying one course does not give access to any other course.
We may add, change or remove courses at any time. Where a course you have already bought is removed, your access to it continues.
Your account
You need an account to buy a course. You are responsible for keeping your account secure and for everything done through it. Accounts are personal to you and must not be shared, sold or transferred.
You must give accurate information when creating an account and keep it up to date. We may suspend or close accounts that appear to be shared, or that are used in breach of these terms.
Payment and access
Prices are shown in Nepalese Rupees and include any applicable taxes unless stated otherwise.
Payment is made through eSewa, Khalti or bank transfer using the details shown at checkout. After paying, you submit the transaction identifier and, where available, a screenshot of the payment.
Access is not immediate. Each payment is checked by us before access is granted. This is normally done within one working day. You will receive an email when your purchase is approved.
If a payment cannot be verified, we will reject it and tell you why. Submitting a false transaction identifier may result in your account being closed.
Refunds
Because course content is delivered digitally and immediately on approval, purchases are generally final.
We will refund you where:
- You were charged more than once for the same course
- Your payment was approved but access was not given and we cannot fix it
- The course is substantially different from its description
Refund requests should be sent to passmarksacademy@gmail.com within 7 days of purchase, with your transaction identifier. Refunds are returned by the same method used to pay.
We do not refund because you changed your mind, because you have already watched the material, or because your device or internet connection cannot play the video.
How you may use the content
When you buy a course you get a personal, non-transferable licence to watch it for your own study, for as long as your account remains open.
You must not:
- Download, record, copy or re-upload any video
- Share your account details so others can watch
- Show the material publicly, or use it for teaching or commercial purposes
- Remove or obscure any watermark
- Attempt to bypass the technical measures protecting the videos
Videos carry a watermark showing your phone number. If material traceable to your account appears elsewhere, we may close your account without refund and pursue any remedy available to us.
Ownership
All course videos, notes, text, images and branding on the site are owned by Passmarks Academy or by the creators who publish through it, and are protected by copyright. Nothing in these terms transfers ownership to you.
Creators
Where a creator publishes a course through Passmarks Academy, that creator is responsible for their content being accurate and for having the right to publish it. Passmarks Academy retains a commission on each sale, at the rate agreed with the creator.
Availability
We aim to keep the service available at all times but do not guarantee it. Access may be interrupted for maintenance, upgrades, or reasons outside our control, including problems with internet or hosting providers.
Our responsibility to you
Courses are educational material. We do not guarantee any particular examination result or academic outcome.
To the extent permitted by law, our total liability to you in connection with the service is limited to the amount you paid for the course concerned. We are not liable for indirect or consequential loss.
Nothing in these terms limits liability that cannot be limited under the law of Nepal.
Ending your access
You may stop using the service at any time and ask us to close your account.
We may suspend or close your account if you breach these terms, particularly where content is shared or copied. Where we close an account for a breach, no refund is due.
Changes to these terms
We may change these terms. The date at the top shows when they were last changed. Continuing to use the service after a change means you accept the revised terms.
Governing law
These terms are governed by the laws of Nepal, and the courts of Nepal have jurisdiction over any dispute.
